The U.S. Supreme Court's Kelo decision regarding the taking of private property for private use has made the passage of state legislation to protect our property rights imperative.
Only two bills will do the job. One was introduced by Delegate Cindy Frich and others, and another was introduced by Sen. John Yoder and others.
Other bills will not protect property owners because they contain a loophole that will allow developers such as McCabe to continue to abuse the property rights of West Virgnia landowners.
We need legislation that will stop the use of eminent domain for the purpose of private use. Exceptions for blight, for municipalities or for any other reason, are unacceptable.
